Terms of Service

Our terms are built on the same principle as our product — transparency, fairness, and zero hidden surprises. Read them once and you will understand exactly how Nufaa works.

Acceptance of Terms

By accessing or using Nufaa — whether through our mobile app, web platform, or local agent network — you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

These terms constitute a legally binding agreement between you ("User," "you") and Nufaa Ltd ("Nufaa," "we," "us"), a company registered in Gambia operating a Sharia-compliant rewards marketplace.

The Wakala Agreement

Nufaa operates strictly on a Sharia-compliant Wakala (agency) model. This is the foundation of everything we do:

  • When you make a purchase through Nufaa, you appoint us as your agent (Wakeel) to acquire and manage Sharia-compliant digital assets on your behalf.
  • No interest (Riba) is ever charged, accumulated, or implied on your account. Your balance can only decrease or remain the same — it will never increase due to charges.
  • The economic relationship is one of agency, not lending. You are not taking out a loan. You are appointing Nufaa to facilitate a transaction using blockchain staking yields.
  • Nufaa earns revenue through a transparent operational fee deducted from staking yields — never from interest on your balance.

This structure has been designed with guidance from Islamic finance principles and is subject to ongoing Sharia compliance review.

Eligibility

To use Nufaa, you must meet all of the following requirements:

  • You must be at least 18 years of age.
  • You must be a resident of The Gambia or accessing services through an authorized Nufaa agent located in The Gambia.
  • You must provide accurate and complete registration information, including a valid Gambian phone number.
  • You must not have been previously suspended or removed from the platform for violations of these terms.

Nufaa reserves the right to verify your identity through local Know Your Customer (KYC) protocols at any time. Failure to provide requested verification may result in temporary account suspension.

Marketplace & Purchases

Nufaa operates a rewards marketplace where you can purchase everyday essentials interest-free. Current offerings include:

  • Utility payments — Nawec electricity tokens and Africell mobile airtime top-ups.
  • Groceries & essentials — Rice, cooking oil, household supplies, and other daily necessities through our local merchant network.
  • Additional items — As the marketplace expands, new product categories will be added and announced through our platform.

Prices on the marketplace reflect the actual cost of goods plus any applicable delivery or agent fees. These fees are disclosed at the time of purchase. Nufaa does not mark up goods to compensate for interest — because there is no interest.

All purchases are final once confirmed. Refund eligibility depends on the nature of the product — utility tokens and airtime are non-refundable once delivered to the provider. Physical goods may be eligible for return or exchange through the originating merchant within 48 hours of delivery.

Staking & Digital Assets

When you deposit funds or make a purchase through Nufaa, the platform acquires Sharia-compliant digital assets and stakes them across enterprise blockchain networks (including but not limited to Cardano, Solana, and Ethereum).

How staking works

  • Staking involves delegating digital assets to support blockchain network validation. In return, the network distributes cryptographic rewards.
  • Nufaa converts these rewards and applies them to reduce your outstanding balance or grow your wallet balance, depending on your account mode.
  • The estimated annual percentage yield (APY) is approximately 4.45%, but this is not guaranteed and fluctuates with network conditions.

Risk disclosure

  • Your principal balance is protected. Staking on Nufaa does not expose you to the risk of losing your deposited funds.
  • Staking yields may decrease during periods of low network activity, meaning your balance reduction may slow — but it will never reverse.
  • Nufaa diversifies staking across multiple blockchains to mitigate concentration risk.

Wallet & Account

Your Nufaa wallet is your personal account on the platform. You are responsible for maintaining the security and confidentiality of your account credentials.

  • You must not share your login credentials, PIN, or account access with any third party.
  • You are solely responsible for all activity that occurs under your account.
  • If you suspect unauthorized access, you must contact us immediately via WhatsApp at +44 7982 144203 or email nufaa.now@hotmail.com.
  • Nufaa reserves the right to freeze or suspend accounts pending investigation of suspicious activity.

User Conduct

By using Nufaa, you agree that you will not:

  • Use the platform for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to circumvent, disable, or interfere with the platform's security features.
  • Create multiple accounts for the purpose of abusing referral programs or promotional offers.
  • Use the platform to launder money, finance terrorism, or engage in any activity that violates Gambian law or international anti-money laundering regulations.
  • Misrepresent your identity or provide false information during registration or verification.

Violation of these rules may result in immediate account termination, forfeiture of staking rewards, and referral to appropriate Gambian authorities.

Limitation of Liability

Nufaa makes every reasonable effort to ensure continuous, reliable service. However:

  • We are not liable for service outages caused by third-party utility providers (e.g., Nawec, Africell) or systemic blockchain network failures.
  • We are not liable for delays in staking yield distribution caused by blockchain congestion or network upgrades.
  • We are not liable for losses resulting from your failure to maintain account security.
  • Our total liability to you for any claims arising from use of the platform shall not exceed the total amount of funds you have deposited in the preceding 12 months.

The platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the uninterrupted availability or error-free operation of the service.

Termination

Either party may terminate this agreement at any time:

  • You may close your account by contacting our support team. Upon closure, any outstanding balance will be settled through remaining staking yields or refunded to your designated payment method.
  • Nufaa may suspend or terminate your account for violations of these terms, suspected fraudulent activity, or regulatory compliance requirements.

Upon termination, your right to use the platform ceases immediately. Any accrued staking rewards up to the date of termination remain yours and will be disbursed within 30 business days.

Changes to Terms

Nufaa reserves the right to modify these Terms of Service at any time. When we make material changes:

  • We will notify you via the app, SMS, or email at least 14 days before the changes take effect.
  • Continued use of the platform after the effective date constitutes acceptance of the updated terms.
  • If you disagree with any changes, you may close your account and withdraw your funds before the effective date.
